1. The service

Kai News (https://kainews.mauroz.xyz) is a subscription email marketing platform operated by Mauricio Zúñiga Cuéllar, NIT 94.060.281-1. By creating an account you accept these terms.

2. Accounts and access

You must register with a valid email and verify it. You are responsible for your password and for all activity in your account, including collaborators you invite.

3. Anti-spam policy (essential)

You may only email people who gave you verifiable consent (opt-in lists). Purchased, rented or scraped lists are forbidden, as is any sending that breaches applicable anti-spam rules (including Colombian data-protection law and Gmail/Yahoo sender standards).

Every email sent through the platform includes one-click unsubscribe. Bounces and complaints are processed automatically and affected addresses are suppressed.

Breaching this policy allows immediate account suspension, with no refund of the current period.

4. Plans, limits and payments

Each account operates under a plan with limits (emails per month, subscribers, collaborators), shown inside the app. We offer a free plan, with no card required, and paid plans that raise those limits; each plan's prices and conditions are shown in the app before any charge.

Payments are processed through an external gateway; we do not store your payment method details. Cancellation and refunds are governed by the Refund Policy.

5. Your content and your subscribers' data

Your content and lists are yours. You authorize us to process them solely to provide the service (send your campaigns, measure results). Personal-data processing is described in the Privacy Policy.

6. Availability and changes

The service is provided "as is", with reasonable availability efforts. We may update features and these terms; substantial changes will be announced in-app or by email.

7. Limitation of liability

We do not guarantee commercial results of your campaigns. The provider's total liability is capped at the amount you paid for the service in the three months preceding the event giving rise to it.

8. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Colombia, where the service's owner resides, and any dispute will be submitted to the Colombian courts.

If you are contracting as a consumer from another country, the above does not deprive you of the protection afforded by the mandatory rules of your country of residence: you keep the rights those rules grant you that cannot be excluded by agreement.
